Limitation of Liability
Neither party shall be liable for any third party claims against the other, except as arises from breach of the Warranty provision above. A party's cumulative liability for damages, if any, for all claims of any kind arising in connection with complaints of performance or breach of this Agreement, other than for breaches of the Confidentiality and Warranty provisions above, is limited to the amount of the fee described in Exhibit 1 received by the party against whom the complaint was filed. Except as arises from breach of the Warranty provision above, neither party is liable for any special, punitive, indirect, incidental or consequential damages, however caused, arising from or in connection with this Agreement............................
In no event will a Buyer be liable to the Supplier for any lost revenues, lost profits, incidental, indirect, consequential, special or punitive damages. In no event will Buyer be liable for the respective actions or omissions of its Affiliates under this Agreement................
